Terms of Service

1. Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of Flagstone ("the Service"), operated by Enbrite LLC ("we," "our," or "us") at flagstonehq.com. By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

We may update these Terms from time to time. If we make material changes, we will notify you by posting the updated Terms and revising the "Effective Date." Your continued use of the Service after changes are posted constitutes acceptance. For significant changes, we may also notify registered users via email.

2. Service Description

Flagstone is a property intelligence service for Philadelphia, Pennsylvania. The Service allows you to enter a Philadelphia property address and receive a report compiled from publicly available government records, including:

  • Office of Property Assessment (OPA) records
  • Licenses & Inspections (L&I) violations and permits
  • 311 service request history
  • Deed transfer records
  • Real estate tax delinquency records
  • Philadelphia Police crime incident data
  • FEMA flood zone designations
  • Nearby permit and violation activity

Reports include data aggregation, risk grading, cost estimates, and AI-generated narrative analysis. The Service also offers address monitoring (change alerts) for subscribed users.

3. Eligibility

To use Flagstone, you must:

  • Be at least 18 years of age.
  • Be capable of forming a legally binding contract.
  • Not be prohibited from using the Service under applicable law.

The Service is currently available for properties located in Philadelphia, Pennsylvania, United States.

4. Accounts

4.1 Account Creation

You may create an account using your email address and a password. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.

4.2 Email-Only Access

You may generate a single free report by providing only an email address, without creating an account. Providing your email constitutes consent to receive the report and a single follow-up communication.

4.3 Account Security

You agree to notify us immediately at hello@flagstonehq.com if you become aware of any unauthorized access to your account. We are not liable for losses resulting from unauthorized use of your credentials.

5. Service

5.1 Free Reports

All Flagstone property intelligence reports are free and unlimited. No payment is required to generate or access reports.

5.2 Address Watch

Address Watch is an optional paid feature that sends you email alerts when a monitored property has new violations or permit activity. If you subscribe to Address Watch, you authorize recurring charges to your payment method until you cancel. Subscriptions renew automatically. You may cancel at any time by emailing hello@flagstonehq.com. Cancellation takes effect at the end of the current billing period. Payments are non-refundable except as required by applicable law.

6. Acceptable Use

You agree not to:

  • Use the Service for any illegal purpose or in violation of any applicable law.
  • Attempt to gain unauthorized access to any part of the Service, other users' accounts, or our systems.
  • Use automated scripts, bots, scrapers, or similar tools to access the Service without our prior written consent.
  • Interfere with or disrupt the Service, servers, or networks connected to the Service.
  • Reverse engineer, decompile, or disassemble any aspect of the Service.
  • Resell, redistribute, or commercially exploit reports or data obtained from the Service without our prior written consent.
  • Submit false or misleading information.
  • Attempt to manipulate, inject prompts into, or extract training data from our AI features.
  • Use the Service to harass, stalk, or harm any person, including using property records to target individuals.
  • Impersonate any person or entity.

We reserve the right to suspend or terminate your access for violation of these Terms, with a 10-day cure period for remediable breaches where practicable.

7. Intellectual Property

7.1 Our Property

The Service, including its design, code, branding, report templates, risk scoring methodology, AI prompts, and original content, is owned by Enbrite LLC and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Service without our prior written consent.

7.2 Your Data

You retain ownership of any personal data you provide (email, name, account information). You grant us a limited, non-exclusive license to use this data solely to operate and provide the Service.

7.3 Report Data

Property data contained in reports is sourced from public government records and is not owned by us or by you. The compilation, analysis, risk scoring, cost estimates, and AI-generated narrative in each report are our original work product. You may share report links and use report content for your personal or professional due diligence purposes. You may not systematically scrape, bulk-download, or commercially redistribute our reports or analysis.

8. Important Disclaimers

8.1 Not Professional Advice

Flagstone does not provide legal, financial, tax, inspection, appraisal, or any other professional advice. Reports are informational tools compiled from public records and AI analysis. They are not a substitute for:

  • A professional home inspection
  • A title search or title insurance
  • Legal counsel
  • A licensed property appraisal
  • An environmental assessment
  • A professional survey

You should consult qualified professionals before making any real estate decision.

8.2 Data Accuracy

Report data comes from publicly available government databases. While we strive for accuracy, we do not guarantee that:

  • Government source data is complete, current, or error-free.
  • Our address normalization correctly matches every property.
  • All relevant violations, permits, or records are captured.
  • AI-generated analysis is accurate, complete, or appropriate for your situation.
  • Cost estimates reflect actual costs you will incur.
  • Risk grades are predictive of future outcomes.

Government databases are updated on varying schedules. There may be a delay between when a record is created by the city and when it appears in our reports. A report reflects a point-in-time snapshot, not a guarantee of current conditions.

8.3 No Warranty

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, COMPLETENESS, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ENBRITE LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).

THIS LIMITATION APPLIES REGARDLESS OF THE LEGAL THEORY (CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE) AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

10. Indemnification

You agree to indemnify, defend, and hold harmless Enbrite LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from or related to:

  • Your use of the Service.
  • Your violation of these Terms.
  • Your violation of any applicable law or the rights of any third party.
  • Any decisions you make based on information obtained through the Service.

11. Dispute Resolution

11.1 Governing Law

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict of law principles.

11.2 Informal Resolution

Before initiating any formal legal proceeding, you agree to first contact us at hello@flagstonehq.com and attempt to resolve the dispute informally for at least 30 days.

11.3 Jurisdiction

If informal resolution fails, any legal action or proceeding arising from these Terms shall be brought exclusively in the state or federal courts located in Philadelphia, Pennsylvania. You consent to the personal jurisdiction of these courts.

11.4 Class Action Waiver

TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.

12. Termination

12.1 By You

You may stop using the Service at any time. You may delete your account by emailing hello@flagstonehq.com. Active subscriptions should be cancelled before account deletion to avoid further charges.

12.2 By Us

We may suspend or terminate your access to the Service at any time if:

  • You materially breach these Terms (with a 10-day cure period where the breach is remediable).
  • We are required to do so by law.
  • We detect fraudulent, abusive, or harmful activity.
  • We discontinue the Service (with reasonable notice to active subscribers).

12.3 Effect of Termination

Upon termination, your right to access the Service ceases immediately. We may delete your account data in accordance with our Privacy Policy. Sections that by their nature should survive termination (including Disclaimers, Limitation of Liability, Indemnification, and Dispute Resolution) will survive.

13. General Provisions

  • Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Enbrite LLC regarding the Service.
  • Severability: If any provision is found to be unenforceable, the remaining provisions remain in full effect.
  • Waiver: Our failure to enforce any provision does not constitute a waiver of that provision.
  • Assignment: You may not assign your rights under these Terms without our prior written consent. We may assign our rights at any time.
  • Force Majeure: We are not liable for any failure or delay caused by events beyond our reasonable control (including natural disasters, government actions, internet outages, or third-party service disruptions).
